We are proud of our commitment, working in close collaboration with our clients, to develop effective and comprehensive estate plans designed to accomplish our client’s goals and objectives. Our attorneys are well versed in all aspects of estate planning and assist clients in estate and trust planning by preparing the necessary core documents, including wills, revocable trusts for probate avoidance, minor’s trusts, durable powers of attorney, advance directives for health care, asset transfer documentation, and we advise clients with respect to beneficiary designations for retirement accounts and insurance policies.  Several of our attorneys regularly practice in both New Hampshire and Massachusetts and are able to assist residents of either state.

Where appropriate, our attorneys provide advice and assistance to clients regarding more complex and sophisticated planning techniques, utilizing plans that may involve certain types of irrevocable trusts, special needs trusts, asset protection trusts, defective grantor trusts, and charitable trusts and foundations.

Our firm also provides legal services in connection with probate, estate settlement and trust administration in New Hampshire and in Massachusetts.  The probate estate settlement process can appear to be confusing and time consuming due to its multiple components and waiting periods.

With the help of our experienced staff of paralegals, we assist clients by filing the necessary papers with the probate court to allow wills and appoint estate fiduciaries, filing the inventory of assets and the accounting of income and expenses, dealing with creditors, arranging for filing appropriate tax returns, and bringing estates to a close in a timely and cost-effective manner. Throughout the probate process, we educate our clients to understand what to expect and we maintain regular client contact to provide needed advice and address sensitive issues.Similarly, we regularly assist clients in the trust administration process, and provide advice and client education with respect to compliance with the requirements of the trust instrument and the uniform trust code.

Elder Law, Medicaid Planning, Guardianships & Special Needs Planning
Our firm advises and assists elderly couples, individuals and their families navigate the sensitive and complex challenges related to aging and the possible need for long term care. We seek to educate our clients about the rules that apply to qualification for nursing home care, and we implement plans designed to preserve and protect client resources through the use of gifts, certain types of irrevocable trusts, wills and testamentary trusts, life estates, care-giver contracts, reverse mortgages, durable powers of attorney, advance directives for health care, and resource spend-down plans. We also assist our clients with preparation and processing of Medicaid applications in New Hampshire or in Massachusetts through application finalization of the approval process.

Our attorneys also have extensive experience helping clients file for guardianships and conservatorships when mental and/or physical disabilities prevent a person from being able to competently make decisions about their personal, health and/or financial affairs.

We frequently assist clients to address the needs of a child or other beneficiary with special needs taking into account how those special needs interrelate with the overall estate plan. A properly drafted “special needs trust” (whether it be a third party “supplemental needs trust,” a first party “D4A trust” or a “pooled trust” that is created by a nonprofit organization) may enable a disabled beneficiary to have access to trust funds for a wide variety of needs while still preserving eligibility for federal and state health care, as well as other benefits including Medicaid and SSI. Our attorneys are experienced in drafting special needs trusts either as part of the estate planning process, or to hold funds that a disabled person receives from the settlement of a lawsuit, an inheritance, or from a life insurance policy.


Real Estate
Our firm has extensive experience in representing developers, individuals, business organizations and financial institutions in the acquisition, disposition, and financing of residential and commercial real estate. As part of our representation of clients in connection with the sale, purchase or financing of developed and undeveloped property, we draft conveyancing and financing documents, negotiate and draft leases, and create condominiums. We serve as agent for numerous title insurance companies, and offer title examination and complete real estate closing services for banking and financial institutions as well as for individuals.
Business Succession Planning and Business Representation
We regularly form corporations, limited liability companies, professional corporations, professional limited liability companies, and partnerships. Our legal services often include the creation of a wide variety of related agreements such as shareholders agreements, operating agreements, employment agreements and cross purchase agreements, as circumstances require.   Our firm represents a variety of business clients, including manufacturers, retailers, and contractors, and we assist our business clients with commercial transactions, mergers and acquisitions, and debt and equity financing.
Our attorneys have experience in business succession planning as well as in advising clients concerning family and closely held businesses. Business owners face numerous issues and opportunities when planning for the transfer of either the ownership interests or the control of a business entity. We assist clients by drafting and implementing shareholder agreements, and assisting in the process of structuring the transaction of sales and gifts of business interests, including utilization of valuation discounts. We consult with our clients to address family concerns and design solutions to protect the value of the business entity, and to address management and equity.
